PUCT Staff and Texpo Power Reach Joint Settlement Agreement to Relinquish REP Certificate
On April 1, 2026 PUCT Staff and Texpo Power filed a joint settlement agreement regarding Texpo Power violations of 16 tac § 25.107(k) and joint petition to approve an application to relinquish a retail electric provider certificate.
“The Staffofthe Public Utility Commission of Texas (Commission Staff) and TexPo Power, LP (TexPo) (together, the parties) file this settlement agreement and joint petition to approve TexPo’ s application to relinquish its retail electric provider certificate. If approved, this settlement package would resolve and conclude Commission Staff’s investigation of TexPo for alleged violations of 16 Texas Administrative Code (TAC) § 25.107(k), concerning failure to comply with requirements necessary to maintain REP certification.
Commission Staff, on behalf of the parties, respectfully requests that the Commission enter an order approving TexPo’s application to relinquish its retail electric provider certificate consistent with the terms set forth in the settlement agreement.”
Among other things the joint stipulation indicates the following:
TexPo committed a significant violation of Commission rules under 16 TAC § 25.107(k)(6) by failing to maintain compliance with the Commission’s access to capital requirements.
TexPo committed a significant violation of Commission rules under 16 TAC § 25.107(k)(16) by failing to remit payment for invoiced charges to transmission and distribution utilities (TDUs). 6.
In lieu of an administrative penalty, the parties agree that TexPo will relinquish its REP certificate and that all proceeds from TexPo’s financial resources previously maintained under 16 TAC § 25.107(f)(1)(B) should be used to satisfy outstanding debts, consistent with 16 TAC § 25.107(f)(6)(A). 7.
If approved, this agreement will resolve all matters related to TexPo’s violations under 16 TAC §§ 25.107(k)(6) and (16).
