Submetered Electric Bill Awaits Governor’s Signature
The Ohio Senate and House adopted a Substitute version of HB173 governing submetering and submetered electric rates.
The bill has been sent to Governor DeWine for his signature or veto.
As Enrolled substituted, HB 173 provides that a submetered utility service provider that resells electricity to a tenant based on residential metered consumption must provide a discount resulting in the tenant’s bill being at least three per cent less than the total bill for electric utility default service.
Note that a recent Ohio Supreme Court decision held that a company providing electric submetering services is a “public utility.” Specifically, the Ohio Supreme Court found that Nationwide Energy Partners, L.L.C. (NEP), which provides electric submetering services, is a “public utility” under the definition in statute. The Court concluded that the Public Utilities Commission of Ohio erred in finding that Nationwide Energy Partners was not a public utility.
