ESCO Seeks Extension in Responding to Notice of Apparent Violation
On August 7, 2026 Mpower Energy filed a response to the New York Department’s Office of Investigations and Enforcement (OIE)’s letter. In this letter. In its response Mpower Energy asks the New York PSC to delay its decision on the May 14, 2026 order to show cause until it receives records from its FOIL request, which is now due by August 28, 2026.
Mpower argues the records are needed to respond to Staff’s allegations and protect its due process rights. It also denies that the Freedom of Information Law (FOIL) request is meant to delay the case or duplicate earlier requests. Mpower asks the PSC to wait for the response before deciding the matter.
