Ohio Adm.Code 4901:1-21-21(A) provides competitive retail electric service (“CRES”) providers with the option to submit a certified request for an expedited return of mercantile customers to the electric distribution utilities (“EDU”) SSO using the Commission’s form or an equivalent EDI transaction.

Ohio Adm.Code 4901:1-1-10-36(A) provides that upon receiving a complete certified request form from a CRES provider for a mercantile customer, the electric utility will complete the request within three business days, regardless of billing cycle.

Regarding Ohio Adm.Code 4901:1-21-21(A), Duke requested a temporary limited waiver until June 30, 2027.  The temporary waiver would enable Duke to complete the development and testing of the relevant EDI capability.  Duke expects that the implementation of the capability will occur sooner than the requested date given that Duke is currently working on the development of the capability with supplier and Staff via the EDI Working Group.

Regarding Ohio Adm.Code 4901:1-1-10-36(A), Duke requested a temporary waiver of the requirement until October 19, 2026.  Duke explained that the brief waiver period would give them adequate time to complete testing and validate an interim manual expedited return process.  Duke stated that its system does not have the built-in capability to “switch” customers in the middle of a billing cycle.

The review and recommendation of Staff states, “Staff has reviewed the Company’s request for temporary limited waivers and find the request to be reasonable.  Staff will continue to monitor the EDI Working Group to ensure process towards implementation.”
