In New York in the ESCO Market Reset Proceeding (Docket Nos. 15-M-0127, 98-M-1343 and 12-M-0476), on December 24, 2024 the PSC denied Smart Energy’s ESCO application, finding that there is a concerning pattern in Smart Energy’s out-of-state conduct and that a review of the record warrants denial of the Company’s application for eligibility to continue marketing electricity to mass market customers in New York, and ordered Smart Energy to drop any mass market customers that Smart Energy is currently serving to default service.
