ERCOT’s petition seeks Texas Commission Declaratory Order affirming ERCOT’ s interpretation of the Commission’ s October 13, 2021 Debt Obligation Order entered in Docket No. 52322, which the Commission issued in response to ERCOT’ s application for a debt obligation order under Public Utility Regulatory Act (“PURA”) § 39.653 (the “Debt Obligation Order”).
Specifically, ERCOT seeks Commission clarification regarding whether end-use customers in the service area of the City of Lubbock, acting by and through Lubbock Power & Light, (“LP&L”) will remain exempt from the assessment of uplift charges, as set forth in PURA § 39.1510-1) and the Debt Obligation Order.
