REP Agrees To Pay $57,000 To Settle Billing Violations
Staff of the Public Utility Commission of Texas and Pulse Power, LLC (Pulse Power) filed a settlement agreement regarding Pulse Power’s violations of 16 Texas Administrative Code § 25.479, related to issuance and format of bills.
Under this settlement agreement, Pulse Power, LLC agrees to pay $57,766 to resolve alleged billing violations under 16 Texas Administrative Code (TAC) § 25.479(b)(1), related to the frequency and delivery of bills.
Alleged Violations of 16 TAC # 25.479(b)(1)
- “Under 16 TAC § 25.479(b)(1), a REP must issue a bill monthly to each customer unless service is provided for a period of less than one month. A REP may issue a bill less frequently than monthly if both the customer and the REP agree to such an arrangement.
- Between October 2023 and November 2023, Commission Staff alleges Pulse violated 16 TAC § 25.479(b)(1) on 25,705 occasions when it experienced a billing system migration issue and failed to timely issue monthly bills for customers who had signed up for e-billing.
- Between October 2023 and April 2024, Commission Staff alleges Pulse violated 16 TAC § 25.479(b)(1) on 3,178 occasions when it experienced a billing system migration issue and failed to timely mail monthly bills to deferred and average payment plan customers.”
Corrective Action
- “Pulse has implemented the following corrective measures to prevent violations of 16 TAC § 25.479(b)(1) from occurring and will maintain such measures going forward:
- Pulse implemented new reporting, processes, and metrics for timely billing, including unbilled usage reports, batch log error queues, enhanced invoice previews, billing timeliness key performance indicators, and operations stability metrics. 11. Additionally, affected customers were offered deferred payment plans (DPPs) without a switch hold and that it provided $70,371 in credits and late fees as well as $194,000 in energy charges which were not billed to the customers.”
