Administrative Rulemaking – Comments Due!
October 16, 2024, the New Hampshire Public Utilities Commission received the Department of Energy’s (DOE) request to extend the time to receive written public comment concerning the Commission’s proposal to update and amend the Commission’s organizational rules. The DOE requested additional time to complete its En 201.05 rule waiver while also preparing written comments on the Commission’s Final Draft Proposal for its Puc Ch. 100 rules. The DOE has requested an extension until November 4, 2024, to file its written comments. Furthermore, the DOE has requested an expedited decision on this request.1 Having reviewed the DOE’s request, the Commission is granting the request in part. The date to file written comment is hereby extended from Tuesday, October 22, 2024, to Tuesday, October 29, 2024.
Public comments are due by October 29, 2024.
As background the NHPUC initiated this rulemaking proceeding to update the commission’s organizational rules and the division of responsibilities between offices, including the NHPUC and the Department of Energy.
Previously on July 12, 2024, the OCA filed comments in response to the proposed rulemaking.
The comments highlight several concerns with the proposal, including (1) the fact the NHPUC did not seek stakeholder input in the initial phase of the rulemaking process; (2) the inclusion of “unincorporated organization[s]” in the definition of “person” in Puc 101.10; (3) the implication of a New Hampshire residency requirement in the definition of “customer” in Puc 101.05; and (4) several factual errors and incorrect references in the proposed rules.
