(“AltaGas” or the “Company”) hereby responds to the Commission’s directive in Order No. 21966 in the above-captioned proceeding to show cause why the Company should not be assessed the maximum penalty of $5,000 per day under D.C. Code § 34-706 from July 6, 2023, through completion of AltaGas’s Term 5 obligation through specific performance. [***]
[ *** ] AltaGas respectfully requests that the Commission adopt an initial penalty for AltaGas of $3,800 per day that adjusts on a monthly basis as AltaGas continues to develop Tier 1 renewable energy until specific performance of AltaGas’s Term 5 commitment is completed. [***}
