“An Act Regarding Energy Fairness” Awaits Gov’s Signature or Veto

As amended, the provisions in LD1949 entitled “An Act Regarding Energy Fairness” have been removed that would have prohibited competitive electricity providers from entering into or renewing an agreement to provide service for residential customers that have received low-income assistance within the last 12 months, unless the Maine PUC finds that the customer would thereby receive a rate lower than the standard offer service rate.

LD1949 bill among other things requires Maine Public Utility Commission (PUC) to:

(1) consider impact on affordability for residential customers in performing its duties;

(2) publish data on utility credit and collection activities on its website;

(3) conduct a comprehensive review of all electric delivery rate components that at least considers options that could: (i) contain customer costs; (ii) reduce utility bill volatility; and (iii) increase utility bill transparency; and

(4) develop an affordability metric to assess the impact of electricity bills on the overall energy burden for residential customers.

Most recent activity on the bill includes the Bill passed to be enacted by the Senate on March 18, 2026 and the Bill passed to be enacted by the House March 17th.
