Commission Files Notice Comment Period Of United American Marketing Corp.’s Application For Electric Supplier License

On October 23, 2023, United American Marketing Corp. (“United American”) filed an Application for License to Supply Electricity or Electric Generation Services to the Public in the State of Maryland (the “Application”). Comments were filed by Commission Staff (“Staff”) and the Office of People’s Counsel (“OPC”). Among other things, those comments raised concerns about Staff’s designation of portions of a formula it used to calculate a civil penalty that it recommended United American be required to pay prior to the Commission granting its Application.
A hearing was held on this issue during the Commission’s weekly Administrative Meeting on March 6, 2024. At that hearing, OPC argued that the redacted portions of Staff’s formula are discoverable under the Maryland Public Information Act. Staff argued that those redacted portions should remain confidential because, if revealed, they would enable the public to calculate certain corporate financial results of the affected companies, which are protected under the Maryland Public Information Act as confidential commercial or financial information. Because this issue could potentially affect other parties besides United American, the Commission invites interested parties who wish to participate on the question of disclosure of the confidential portions of Staff’s formula to file comments, referencing “Case No. 9728” in the subject line, with the Commission by April 29, 2024.
