Commission Files Proposed Meeting Minutes From COMAR Rulemaking Session

Discussion: PC44 Time-of-Use (TOU) Rate Design Workgroup Leader, Brett Sproul, provided a brief overview of the proposed changes and how the PC44 TOU Rate Design Workgroup developed the proposed changes to COMAR 20.50.01 General and COMAR 20.50.10 Net Metering. Staff recommended deferral of the adoption of these proposed regulations because the concern is that the proposed regulations would discourage net energy metering (NEM) customers from participating in load shifting via PC 44. Chair Hoover and the Commissioners expressed the need to move rapidly to develop regulations in order to expand the TOU program and increase customer participation opportunities for TOU rates. The discussion centered on net metering customers having the right to participate in TOU rates. See transcript for verbatim discussion. 

Commission Motion: Chair Hoover moved to publish the following draft revised regulations, in accordance with today’s proceeding, in the Maryland Register for notice and comment, subject to non-substantive changes necessary to conform to COMAR drafting requirements. 

Revise the following Regulations: COMAR 20.50.01.03 Definitions COMAR 20.50.10.04 Calculation of Net Energy COMAR 20.50.10.05 Net Excess Generation 

The motion passed unanimously.
