Commission Staff Files Report On SB 1 Residential Retail Supply Price Caps

The report provides Staff’s recommendations regarding implementation of the residential retail supply price caps, focusing on outstanding implementation issues and application of the caps to new and renewed residential retail supply contracts on and after January 1, 2025. [ *** ] 

From Report: 

Staff makes the following recommendations regarding trailing 12-month average residential retail supply price caps, pursuant to § 7-510(d)(2) and § 7-604.2(b)(2) of the Public Utilities Article (“PUA”). 

  1. Staff recommends that the Commission require utilities to file the trailing 12-month average rates in PC 64 by the fifth business day of the month, for that month. For example, utilities should file by the fifth business day of January 2025 the trailing 12- month average residential SOS and Default Gas rates including January 2025 rates. 
  2. Staff recommends that the Commission order that the dates of applicability for the 12- month average residential price caps are all the days in the month that follows the 12 months that established the price cap. For example, the trailing 12-month average residential SOS and Default Gas rates through December 2024, should be the price cap for residential retail supply contracts entered into or renewed on January 1, 2025, through January 31, 2025. 
  3. Staff recommends that the Commission require utilities to provide the dates of applicability for each trailing 12-month average rate in PC 64 filings. 
  4. Staff recommends that the Commission order that residential retail supply contract renewals pursuant to PUA § 7-510(d)(2)(iii) and § 7-604.2(b)(2)(ii) must renew at a rate that does not exceed the 12-month trailing average price caps in PUA § 7-510(d)(2)(i) and § 7-604.2(b)(2)(i) as of the date of the renewed contract. 
  5. Staff recommends that the Commission order that all residential retail choice contracts subject to PUA § 7-510(d)(2) and § 7-604.2(b)(2) state all prices in explicit numeric terms for the duration of the contract. 
  6. Staff recommends that the Commission request comment on this report. [ *** ]
