Customer Complaint Filed Against REP For Using Photo/Facial Recognition In Enrollment Verification Process

Excerpts from Customer Complaint:

“Complainant requests discovery into Respondent’ s practices that are relevant to this complaint. Specifically: (i) Respondent’ s contracts with Persona; (ii) An accounting of all monies received from Persona in connection with Respondent’ s requirement of new customers to submit data as a condition to receiving electric service; (iii) A list of all customers or applicants denied service because they refused to submit data to Persona; (iv) A detailed audit or description of how Respondent and Persona use personal information (including SSNs, photos, biometrics, etc.) obtained from applicants; (v) A detailed description of Respondent’ s data safekeeping practices, including data safekeeping by their affiliates or partners; and (vi) Adequate assurances that Respondent maintains insurance, bond, or other security to protect its customers in the event of a data breach. 

“In addition, Respondent’ s denial of service to Complainant has resulted in the expiration of Complainant’ s fixed-price contract. Complainant now pays more for electricity than he should, had Respondent acted properly. Complainant seeks a monetary award to compensate him for the difference between his current rate and the rate he signed up for with Respondent.”
