FCC Proposes First-Of-Their-Kind AI Generated Robocall And Robotext Rules
The Federal Communication Commission officially implemented new rules to regulate AI-generated “robocalls” and “robotexts.”
Proposal seeks comment on requiring callers to disclose if they use AI in robocalls and robotexts and protecting the communications accessibility benefits of AI.

The FCC adopts mandatory disclosure requirements for AI-generated calls and texts.
“This item also proposes protections to ensure that positive uses of AI that already help people with disabilities use the telephone network can thrive without threat of Telephone Consumer Protection Act liability. In a Notice of Inquiry, the Commission seeks additional comment and information on developing technologies that can alert consumers to AI-generated unwanted and illegal calls and texts.”
Among other things this rule includes:
Mandatory Disclosure: Callers using AI to generate robocalls or robotexts must disclose this at two critical points: 1) when obtaining prior express consent from consumers and 2) at the start of each communication. This requirement ensures that consumers are aware they are interacting with AI-driven communications, which is designed to aid consumers in making informed decisions and avoid potential scams.
Protection for Beneficial AI Uses: The rules also safeguard AI technologies that assist people with disabilities. These beneficial uses are protected under the TCPA and are not subject to the same restrictions as AI-generated telemarketing efforts.
