A Massachusetts Hearing Officer filed request for further comments “to assist the Department in issuing its Final Order”

{***} “The Department invites additional written comments in light of the developments discussed above. Specifically, the Department requests comment regarding the following issues:

Whether and how the Department’s decision in Order 20-80-B affects the analysis previously offered by commenters in response to the Department’s questions in this docket. 

  • D.P.U. 18-152 at 5 (posing questions regarding the evidentiary burden to demonstrate the availability of an alternative to service under tariffed rates); and 
  • D.P.U. 18-152 at 6 (posing questions regarding filing requirements for petitions seeking approval of gas special contracts). 

Commenters’ positions regarding the Attorney General’s arguments in D.P.U. 20-80 that gas special contracts should demonstrate: (1) net benefits to customers; and (2) that the customer’s use of natural gas is no more harmful in terms of GHG and air pollutant emissions than the customer’s alternative energy resource(s) (D.P.U. 20-80, Attorney General Comments at 41-43, May 6, 2022). o Commenters’ positions regarding the Attorney General’s February 2020 comments in D.P.U. 18-152 regarding whether service curtailment provisions provide an adequate basis for granting a departure from service under tariffs to service under a gas special contract. 

Written comments may be filed no later than 5:00 p.m. on Friday, January 31, 2025. Reply comments may be filed no later than 5:00 p.m. on Friday, February 14, 2025.
