OCA Files Letter Stating It Will No Longer Oppose Planet Energy’s Settlement
OCA filed letter in opposition to the settlement but acknowledging due to the supplier’s insolvency and “other pressing matters” it would no longer pursue its opposition.
As background, on May 5, 2024, parties filed a proposed settlement agreement.
Provisions include: (1) $1 million civil penalty; (2) a recognition by Staff that recovery of any civil penalty “is unlikely due to the bankruptcy proceeding of Planet Energy’s parent company in Canada” and agreement by Staff not to pursue collection of the imposed civil penalty; and (3) surrender by Planet Energy of its electric supplier license and agreement to never do business of any kind in Pennsylvania, in perpetuity.
As background, the PAPUC’s independent Bureau of Investigation and Enforcement has filed a complaint against retail supplier Planet Energy. The central allegation is that Planet Energy canceled fixed-rate contracts without the required notices to customers. The BIE is seeking a civil penalty of $500 per impacted customer, for a total of $2,845,000, and the revocation of Planet Energy’s license to operate as a supplier in Pennsylvania.
