Parties Filed Responsive Comments On Rules R8-63 And R8-64

Staff recommends only minor changes.  

North Carolina Sustainable Energy Association (NCSEA) argues that “the amended rules inappropriately place the burden of data collection and analysis on the applicant—when it is the affected system operator (“ASO”) that controls, maintains, and functions as gatekeeper to the data at issue,” recommending NCUC “consider a rule change that requires the interconnecting utility and the ASOs (once they are determined to be affected) to automatically be made parties to CPCN proceedings convened pursuant to rules R8-63 and R8-64”.

Carolinas Clean Energy Business Association (CCEBA) “opposes any rule change which would determine the readiness of a merchant plant CPCN application solely on the basis of whether a third party completely outside the control of the applicant has performed studies in a timely fashion.”  

CCEBA also opposes changes that “would require an applicant to subject itself to significant withdrawal penalties in the interconnection study process in order to obtain the information required for a CPCN application but would then cause the applicant (in most cases) to forfeit those penalties if its CPCN application were to be denied.”

Reply comments are due by May 31, 2024.  

Previously on May 1, 2024, the NCUC issued order extending the deadline for comments on rules R8-63 and R8-64.

As background, on April 1, 2024, the NCUC issued order requesting comments on proposed revisions to Commission Rules R8-63 and R8-64,” which are “are intended to formalize application requirements, increase the efficiency of the application process, and, ultimately, provide the Commission with the evidence necessary for a determination of whether granting an application is the in public interest”   NCUC Staff filed a petition to amend NCUC rules R8-63 and R8-64. These rules provide the filing requirements for a CPCN application for electric generating facilities not constructed by a public utility.
