PUC Approves Utility’s Unopposed Agreement to Change Rates
On July 30, 2026, the Public Utilities Commission of Texas (PUCT) issued an order approving the application of Texas New-Mexico Power Company (TNMP) for authority to change its rates.
As background, o May 29,2026, TNMP filed an unopposed agreement that, among other things, provides for a $4,499,931 increase in TNMP’s total base-rate revenue requirement.
Signatories to the agreement included TNMP, Commission Staff, the Office of Public Utility Counsel (OPUC), Cities Served by TNMP, Alliance of TNMP Municipalities (ATM), Texas Industrial Energy Consumers (TIEC), Texas Competitive Power Advocates (TCPA), Walmart Inc., Hunt Energy Network, LLC, Data Center Coalition (DCC), and Crusoe Energy Systems, LLC, CyrusOne, LLC, and Hut8Corp (collectively, Joint Data Center Group (JDCG)). The only other parties, Texas Energy Association for Marketers (TEAM) and Amazon Data Services, Inc, (ADS), are not signatories but were unopposed to the agreement.
The Commission approves the rates, terms, and conditions set forth in the agreement to the extent provided in this Order.
Agreement – Tariff Language, Cost Allocation, and Rate Design
- Under the agreement, the rates are based on the class allocations reflected in the class cost-of-service study summary and in the revenue distribution summary included in attachment 4 of the agreement.
- Under the agreement, the rate design and tariff language in TNMP’s current approved tariffs will be revised to incorporate the revised rates approved by this Order and the following changes:
- the addition of the Rider RCE – Rate Case Expense Surcharge to TNMP’s tariff for retail delivery service as reflected in attachment 2 to the agreement;
- the addition of the interim rates surcharge to recover the difference between interim rates and the rates approved by this Order for the period from May 22,2026, through the effective date of the rates approved in this Order, in accordance with SOAH Order No. 4 and as reflected in attachment 7 to the agreement, to be recovered during 2026;
- the addition of Rider HCRF for recovery of system restoration costs associated with Hurricane Beryl in the amount of $20,509,755 plus carrying charges, with the balance amortized over five years, as reflected in attachment 5 to the agreement;
- the addition of Rate XFMR – Wholesale Substation Service in TNMP’s tariff for wholesale delivery service as reflected in chapter 3 subsection 2 of the tariff included in attachment A to TNMP’s response to orders requiring clarification and unopposed motion to admit evidence; and
- all other changes to the tariffs proposed by TNMP that do not conflict with, and are not otherwise addressed by, the agreement.
TNMP Distribution Rates– The new delivery rates are to be effective for electricity bills rendered on and after 45 days from the date of the PUC order approving the rates.
