PUCO Adopts Settlements Resolving Retail Supplier Violations For Direct Energy Services, Xoom Energy Ohio
The Public Utilities Commission of Ohio (PUCO) today accepted two separate settlement agreements resolving alleged violations of retail energy supplier regulations for Direct Energy Services, LLC and Xoom Energy Ohio, LLC.
Direct Energy – Under the terms of the settlement approved today, Direct Energy Services will pay a $275,000 civil forfeiture to the state of Ohio, make a one-time $100,000 contribution to Dollar Energy Fund, a nonprofit providing bill payment assistance, and cease using digital third-party verification services to confirm future customer enrollment.
PUCO staff notified Direct Energy on June 9, 2021, of apparent violations of various PUCO marketing, solicitation and enrollment regulations.

Xoom Energy – Under the terms of the settlement approved today, Xoom Energy Ohio will pay a $120,000 civil forfeiture to the state of Ohio, make a one-time $100,000 contribution to Dollar Energy Fund, and credit or rebill customers who were enrolled without proper consent. Xoom Energy Ohio must identify impacted customers and offer to switch them back to the local utility’s default rate and offer refunds or credits.
A PUCO staff investigation revealed numerous instances in which a customer was enrolled without proper consent, and the retail supplier was likely in violation of numerous PUCO marketing, solicitation and enrollment regulations.
