PURA Rules On DEEP’s Motion And Requires Electric Suppliers To Update Disclosure Labels

Electric suppliers are required to update their Disclosure Labels to include Table 2 from DEEP’s motion.

From Ruling to Motion: 

On June 24, 2024, the Department of Energy and Environmental Protection’s Bureau of Energy and Technology Policy (DEEP) submitted a motion (Motion No. 5) to the Public Utilities Regulatory Authority (Authority or PURA) requesting to file two tables, Tables 1 and 2. DEEP asserts that both tables contain information from its Greenhouse Gas emissions report (GhG Report). Motion No. 5, p. 1. Table 1 contains the information in the format approved in the ruling on Motion No. 4 and Table 2 contains more detailed information. Motion No. 5, p. 1. In Motion No. 5, DEEP also requests that electric suppliers use Table 2 in the construction of the suppliers’ emissions source labels. Id., p. 1. DEEP attached Tables 1 and 2 to Motion No. 5.

On January 29, 2024, the Office of Consumer Counsel (OCC), on behalf of the Disclosure Label Working Group, submitted a report (Report), including proposed Disclosure Labels and guidelines, as required by the VRO Decision.  See Motion No. 4. The proposed Disclosure Label submitted with the Report included a section containing emissions information; however, OCC stated that Disclosure Label Working Group participants did not have an opportunity to provide feedback regarding such information and therefore encouraged participants to provide feedback on Motion No. 4 to PURA. Id., n3. No party or intervenor provided any comments regarding Motion No. 4.

In the Report, OCC also stated that emission information is currently available in DEEP’s GhG Report, however, the information is not in a format that can be easily inserted into the Disclosure Label. Id., p. 3. Therefore, DEEP needed to calculate the emission numbers to be included in the proposed Disclosure Label and provide such numbers to the Disclosure Label Working Group. Id. According to the Report, going forward, DEEP planned to make the information regarding the emissions available in the GhG Report in a format that electric suppliers may insert into the supplier’s Disclosure Label. Motion No. 4, p. 4.

The Authority reviewed Tables 1 and 2 and determined that such tables contain the information required by the VRO Decision and General Statutes § 16-245p(b)(3).2 See VRO Decision, pp. 29–32, 35. In addition, the Authority agrees that electric suppliers should use Table 2, which provides more detailed emissions information, in their Disclosure Labels. Accordingly, the Authority directs electric suppliers, no later than August 19, 2024, to update their Disclosure Labels to include Table 2. In addition, going forward, the Authority directs electric suppliers to update their Disclosure Labels with information from DEEP’s most recent GhG Report within two months of DEEP’s publishing of such report.
