Saga Continues – ALJ Extends Time To Review Disposition of Enron Energy’s REP Application
“Under 16 Texas Administrative Code (TAC) § 25.107(c)(3), an administrative law judge (ALJ) will issue an order approving, rejecting, or approving with modifications, an application within 90 days of finding an application sufficient except where good cause exists to extend the time for review. In this case, the 90-day deadline falls on Monday, August 11,2025.
On August 4, 2025, Commission Staff filed a supplemental recommendation on final disposition. On August 7,2025, Enron Energy Texas, LLC filed its response to Commission Staff’s supplemental recommendation on final disposition.
In light of the recent filings, the multiple extensions requested by the parties over the course of this case, and the lack of agreement on final disposition between the parties, the ALJ finds good cause exists under 16 TAC § 25.107(c)(3) to extend the time for review in this proceeding.
Additional deadlines for continued processing of this case will be established in a future order.
Enron Energy Texas LLC in a Texas PUC filing alleged that a recommendation from Staff of the Texas PUC, in which Staff recommends denial of Enron Energy Texas LLC’s Option 1 Texas retail electric provider application, fails to cite any grounds for denial under the REP certifications rules.”
