Spark Energy Seeks Reconsideration of Exceptions Filed In Utility’s Default Service Plan
On September 15, 2026 Spark Energy filed a petition asking the Pennsylvania PUC to reconsider its decision to strike Spark’s exceptions in FirstEnergy’s DSP VII proceeding .
Spark Energy argues that the PUC should consider its record-based legal objections to FirstEnergy’s supplier tariff revisions, even if Spark is not granted intervention, because doing so would require no new evidence or delay.In response on September 21, 2026 parties filed answers opposing Spark Energy’s petition for reconsideration.
FirstEnergy argues that Spark knowingly chose not to intervene in the DSP VII proceeding despite having notice of the proposed supplier tariff changes. FirstEnergy maintains that Spark’s disagreement with the recommended decision does not justify late intervention or consideration of its exceptions.
CAUSE-PA asks the PUC to deny reconsideration and uphold its decision striking Spark’s exceptions, arguing that Spark identifies no new evidence, legal error, or overlooked material issue and that considering its exceptions could prejudice existing parties.
