Supreme Court Schedules Oral Argument in Utility Complaint Against Submetering Company

On June 22nd, the Supreme Court of Ohio filed notice of oral argument notice of oral argument regarding Duke Energy’s complaint against the submetering company Nationwide Energy Partners (NEP).

In the complaint Duke Energy alleged that NEP has engaged in “unlawful and exploitative submetering activities in Duke Energy Ohio’s service territory.

The Supreme Court of Ohio will hold an oral argument on August 6, 2026 at 9:00 a.m. ET.

As background, among other things Duke Energy argued that it forced abandonment of Duke Energy Ohio’s customers through the installation of master-metering equipment to convert existing and individually metered Duke Energy Ohio customers to submetered customers of NEP.
