Texas Commission Staff Files Final List of Providers of Last Resort (POLR) For 2027-2028 Term
Staff of the Texas Public Utility Commission filed the final list for the designation of Providers of Last Resort (POLR) for the 2027-2028 term.
A deadline of September 7, 2026, was established after the issuance of Staff’s preliminary report for any REPs to challenge their ability to be designated as an LSP POLR.
BP Energy Retail Company, LLC (“BP Energy”) did not file a challenge, but the company provided notification of its opt-out of eligibility for the small non-residential and medium non-residential customer classes due to minimal service under 16 TAC § 2543(h)(2)(H). BP Energy was removed from the small non-residential list for the CenterPoint area in addition to all areas in the medium non-residential list. As the affidavit for BP Energy had been overlooked during data entry, during the challenge review it was also found that BP Energy was listed on the residential list in the AEP North territory, even though it did not meet the criteria with a percentage of less than 1.0%. Staff removed the listing.
ResidentShield Power TX, LLC (“ResidentShield”) filed a challenge on September 3, 2026. ResidentShield noted that it did not meet the criteria of 16 TAC§ 25.43(h)(2)(B) with a percentage less than 1.0%. Staff agreed to the challenge and ResidentShield was removed in the Oncor, Centerpoint and TNMP areas of the residential list, and the Oncor and TNMP areas of the small non-residential list. With the removal of ResidentShield from the Residential list, eligible replacement LSPs were added to have the maximum number of fifteen59 listings specified in 16 TAC § 25430)(2).
