Three More Suppliers Fined for Failure to File Required Reports

On June 4, 2026 the Illinois Commerce Commission (ICC) issued final orders fining three more retail electric suppliers for their alleged failure to file required reports.

In each of these three cases the ICC adopted Staff’s recommendations, setting the fines at half of the initial proposed fine reflecting that each supplier came into compliance with their reporting obligations within 30 days of the initial show cause order.

Specifically the ICC issued a final order  against Messer Energy Services, Inc. fining the retail supplier $27,500 for the following alleged failures: 1) failing to file its Annual Report of Compliance with the Retail Charge Provisions of the Renewable Energy Portfolio Standard due by September 1, 2022, September 1, 2023, and September 1, 2024 in accordance with 83 Ill. Adm. Code 455.125; 2) failing to file its Call Center Information Report by March 1, 2022, March 1, 2023, and March 1, 2024; 3) failing to file a Net Metering Report due April 1, 2022, April 1, 2023, and April 1, 2024 in accordance with 83 Ill. Adm. Code 465.40; and 4) failing to file its Designated Agent Form by January 31, 2024”.

The ICC also issued a final order issued against EcoPlus Power LLC fining the retail supplier $26,250 for the following alleged failures: 1) failing to filed its Annual Compliance Certification Report due April 30, 2023 in accordance with 83 Ill. Adm. Code 451.710; 2) failing to file its Annual Rate Report due June 30, 2023 in accordance with 220 ILCS 5/16-115A(a)(iii); 3) failing to file its Annual Report of Compliance with the Retail Charge Provisions of the Renewable Energy Portfolio Standard due by September 1, 2024 in accordance with 83 Ill. Adm. Code 455.125; 4) failing to file its Call Center Information Report by March 1, 2023, and March 1, 2024; 5) failing to file a Net Metering Report due April 1, 2023, and April 1, 2024 in accordance with 83 Ill. Adm. Code 465.40; 6) failing to file its Designated Agent Form by January 31, 2024; and 7) failing to file an Environmental Disclosure Statement which should have been filed in January 2023, April 2023, July 2023, October 2023, and October 2024 in accordance with 83 Ill. Adm. Code 421.30.

Similarly the ICC issued a final order issued against APN Starfirst, L.P. fined the supplier $18,250 for the following alleged failures: 1) failing to file its Annual Report of Compliance with the Retail Charge Provisions of the Renewable Energy Portfolio Standard due by September 1, 2022, September 1, 2023, and September 1, 2024 in accordance with 83 Ill. Adm. Code 455.125; 2) failing to file a Net Metering Report due April 1, 2022, April 1, 2023, and April 1, 2024 in accordance with 83 Ill. Adm. Code 465.40; 3) failing to file an Environmental Disclosure Statement which should have been filed in October 2021, January 2022, April 2022, July 2022, October 2022, January 2023, April 2023, July 2023, October 2023, January 2024, April 2024, July 2024, and October 2024 in accordance with 83 Ill. Adm. Code 421.30.
