PSC Grants Motion to Stay and Extends Procedural Schedule in Pepco Rate Case
Commission sets electric rates subject to adjustment pending a new order
In a press release issued on May 11, 2026 the Public Service Commission of the District of Columbia (Commission) announcing that “it has formally responded to the District of Columbia Court of Appeals’ reversal in Formal Case 1176. Through Order No. 22860, issued May 8, 2026, the Commission resolved matters raised by participating parties in the remand proceeding for Pepco’s second Multiyear Rate Plan, known as the “Climate Ready Pathway.”
The new order establishes a revised procedural schedule for the Commission’s continued review on remand and addresses multiple motions filed following the Court’s decision.
To guide the remand process, the Commission has ruled on the following key issues:
Granted a procedural stay and extension – As jointly requested by the Office of the People’s Counsel for the District of Columbia (OPC), the District of Columbia Government, and the Apartment and Office Building Association of Metropolitan Washington (AOBA), the Commission granted the Motion to Stay the Procedural Schedule established in Order No. 28806 and granted AOBA’s request to extend the schedule.
Adopted a Revised Remand Procedural Schedule – The Commission required Pepco to file updated testimony and established a revised remand procedural schedule.
Reauthorized current rates – The rates contained in Pepco’s tariff and updated compliance filing (submitted December 11, 2024) are reauthorized during the remand period. These remain subject to adjustment upon the issuance of a new rate order.
Denied requests for immediate rate suspensions and refunds – The Commission denied requests from OPC and AOBA) to suspend the currently approved multiyear rate plan, restore prior rates, and issue refunds to ratepayers consistent with the Court’s reversal.
Adopted additional directives to guide the ongoing remand process
