New Telemarketing Law Signed into Law
On July 20, 2026 Governor Shapiro has signed Senate Bill 992 into law.
On July 12, 2026, the Pennsylvania House and Senate unanimously passed SB 992 and sent it to Governor Josh Shapiro.
The new law is effective October 18, 2026 so businesses have 90 days to make sure they are ready to comply with the new requirements.
Among other things, Senate Bill 992 amends the Telemarketer Registration Act to make it unlawful for telemarketers to spoof phone numbers to make it appear as if they are calling from the same area code. It also prohibits telemarketers from making robocalls after 7 p.m., before 9 a.m., or on a Sunday.
Companies that place sales calls, sends promotional texts, uses robocall or ringless voicemail platforms, or hires telemarketers to reach Pennsylvania consumers must comply with the new law.
More specifically the new statute covers text messages, voicemails, and ringless voicemails; bans telemarketing on Sundays and outside 9:00 a.m. to 7:00 p.m. on other days; requires prior express written consent for robocalls; prohibits AI-generated deception and caller ID spoofing; and extends liability to the company that hired the telemarketer, not just the one dialing. Penalties run up to $1,000 per violation, and $3,000 where the consumer is 60 or older.
Note that communications made with prior express written consent, or under an established business relationship within the past 12 months, fall outside the definition of telephone solicitation.
This Act amends the act of December 4, 1996 (P.L.911, No.147), known as the Telemarketer Registration Act, further providing for definitions, for registration requirement, for unlawful acts and penalties, for blocking of caller identification and other telemarketing screening products or services prohibited, for unwanted telephone solicitation calls prohibited, for violations and for investigation.
