Formal Residential Complaint Filed Against REP
On August 5, 2026 a residential customer Craig Frazee filed a formal complaint with the Public Utility Commission of Texas (PUCT) against TXU Energy.
In the complaint the residential customer alleges that under the TXU Energy Flex Rewards variable-rate plan, TXU overcharged him compared to the historical average price per kWh that TXU is required to publish under the Electricity Facts Label (EFL). The complainant also alleges that TXU’s rate chart, which includes Oncor delivery charges, shows lower average kWh prices than those actually billed in multiple months, resulting in significant overcharges, potentially nearing $100 in one month and extending back before May 2024.
The complaint further contends the PUCT Consumer Protection Division improperly dismissed his informal complaint by focusing only on TXU’s broad discretion over variable rates instead of reconciling billed rates with the published rate chart. The complaint seeks refunds for and other Flex Rewards and a formal investigation and adjudication by the Commission.
