Parties File Comments Regarding The Implementation Of The Legislative Energy Relief Refund

From Request for Comments: [ *** ] During the 2025 Legislative Session, the Maryland Geneal Assembly passed the Next Generation Energy Act which was signed into law by Governor Wes Moore on May 20, 2025. As part of the Next Generation Energy Act, the Commission is required to oversee the crediting of the “Legislative Energy Relief Refund” to residential distribution customers that are subject to the Renewable Energy Portfolio Standard. Each residential distribution customer is to be credited based on the customer’s consumption of electricity supply. The credits are to be issued in two disbursements: half in a peak summer month and half in a peak winter month during fiscal year 2026. On May 21, 2025, Baltimore Gas and Electric (BGE), Potomac Electric Power Company (Pepco), and Delmarva Power and Light (Delmarva) (together the “Exelon Utilities”) filed a proposal to implement the Legislative Energy Relief Refund. 

Accordingly, the Commission initiates this Public Conference (“PC 70”) for the use of collecting data for the Legislative Energy Relief Refund. Parties may submit comments as to implementation of Legislative Energy Relief Refund, including reactions to the Exelon Utilities proposal by June 4, 2025. Additionally, the Commission hereby directs all electric companies to answer the attached questions by June 4, 2025 as well.

  1. What is the total number of alternative compliance payments paid by your company for the previous calendar year?

    2. What is the total residential usage in kWh for the previous calendar year?

    3. Do you recommend the percentage of relief funding each utility receives be based on the total number of alternative compliance payments made by each utility or the total residential usage?

    4. Do you have recommendations for the peak months during which the refunds should be distributed?

    5. Do you have any other related recommendations?
