Commission Stays Decision – Awaits Customer Data Platform Legislation

The New Hampshire Public Utility Commission  issued a procedural order approving the data platform Governance Council’s updated RFPs “concerning the procurement of consultants to manage the buildout project and consultants to develop the New Hampshire Energy Data Sharing Platform Hub,” but stayed their issuance for 60 days given pending legislation that would repeal the multi-use energy data platform statutes. 

HB709 has been passed by the House and is under consideration in the Senate Energy and Natural Resources Committee.  This bill if approved would repeal the statewide data platform requirement. 

In comments OCA argued that the NHPUC lacks the authority to stay the issuance of the RFPs and that the conclusion that repeal of the multi-use energy data platform statutes would mean “the efforts of the GC [i.e., the data platform Governance Council] in developing the platform will conclude” is at best premature and potentially erroneous given that applies to all utility capital investments.”
