Bills to Watch

HB 80 (Smith) was introduced and referred to the Natural Resources and Energy Committee on March 18, 2024.  

This bill would roll the RPS requirement for utilities back to 10% from its current 25% and temporarily suspend the annual increases intended to bring Delaware to 40% renewable energy generation by 2035. According to the proposed legislation, the current renewable energy policy has resulted in renewable energy demand that significantly outpaces supply. This amended policy would hold the RPS requirement at 10% for a period of 10 years, allowing renewable generation capacity to catch up to the demand created by RPS requirements. At the end of this period, the annual increases of the RPS requirements would resume.

HB 80 (Smith) was introduced and referred to the Natural Resources and Energy Committee.

This bill would require the disclosure of votes cast at meetings of the PJM regional transmission organization through an annual report to the DEPSC, Governor, and General Assembly that includes each recorded vote from the previous calendar year.

Note that although suppliers in Delaware do not currently have RPS compliance obligations, this legislation could reduce the demand for RECs in the state, thereby impacting suppliers involved in renewable energy generation.

SB 61 (Hansen) if approved would require the disclosure of votes cast at meetings of the PJM regional transmission organization through an annual report to the DEPSC, Governor, and General Assembly that includes each recorded vote from the previous calendar year.
