Hearing Examine Issues Competitive Residential Market Next Steps Memo
The hearing examiner issued Competitive Market for Electric Supply – Next Steps.
Staff hopes to work with stakeholders to gain broad consensus around the proposed approach, revised as appropriate based on stakeholder input:
- We expect no support from unscrupulous suppliers
- In contrast, we hope that scrupulous suppliers will see the benefit of “competing on an even playing field” and eliminating the uncertainty regarding the market’s future
- If it appears that broad consensus is possible, staff will work with stakeholders on the necessary Energy Switch modifications and customer protections
As reported previously, Massachusetts DPU Staff presented its proposal at an in-person meeting on March 6, 2025 would make drastic changes to the residential electricity market in the state. Staff’s presentation claims “the future of the competitive market remains uncertain and contentious” in Massachusetts, with legislative action apparently stymied while the Attorney-General is making significant claims about alleged economic loss to supplier residential customers. Staff said further that reforms which “nibble around the edges” of the retail market issues in the state are not sufficient, and what is needed is a “market reset.”
As previously reported, staff’s initial proposal, among other things recommends:
- elimination of door-to-door and telemarketing sales channels;
- elimination of direct mail and “table-top marketing” channels even with the acknowledgement that these channels can be customer-friendly;
- require that all residential sales occur only through the state’s MAEnergySwitch shopping website;
- eliminate automatic renewals and instead require customers to re-enroll through Energy Switch at the end of each contract term (or returned to Basic Service if no action is taken);
- customers on a variable price be required to re-enroll monthly through Energy Switch. Customers that did not re-enroll, or enroll with another supplier, would be returned to Basic Service; and
- renewable energy products must be listed on MA Energy Switch whereby the voluntary renewable energy content of the product must be composed entirely of MA RPS Class 1 RECs.
