Texas PUC Staff Support Retail Provider’s Request To Be Relieved Of Non-Volunteer POLR Obligation
Staff of the Texas PUC have recommended that the PUC approve MidAmerican Energy Services, LLC’s petition to be relieved of MidAmerican Energy Services, LLC’s current designation as a large service provider (LSP, or non-volunteer POLR) for the 2025-26 term
MidAmerican Energy Services had said that it no longer has any Texas customers and, as a result, no longer meets the requirements under 16 TAC § 25.43 (h)(2)(B) to be eligible as a POLR provider.
As previously reported, MidAmerican Energy Services sold its competitive retail electric business to Constellation last year
Staff stated, “With the asset purchase agreement made between MidAmerican [REP] and Constellation NewEnergy, Inc., MidAmerican does not meet the eligibility requirements of §25.43(h)(2)(B), therefore there is good cause to allow the termination of MidAmerican’s designation as an LSP.”
MidAmerican Energy Services is listed as an LSP in the AEP North, AEP Central and Texas-New Mexico Power Company (TNMP) transmission and distribution service areas for the Medium Non-Residential customer class. Additionally, MidAmerican Energy Services is listed as an LSP in the Oncor Electric Delivery Company, CenterPoint Energy Houston Electric LLC, TNMP, AEP Texas North, and AEP Texas Central service areas for the Large Non-Residential customer class.
