PUC Dismisses Utility’s Proposed Default Service Because New Law Eliminated Electric Security Plans (ESPs)

“In this Entry, the Commission dismisses the application to establish an electric security plan filed by Ohio Edison Company, The Cleveland Electric Illuminating Company, and The Toledo Edison Company.”

“On May 15, 2025, Governor DeWine signed Substitute House Bill Number 15 (Sub. HB 15). Among other provisions, Sub. HB 15 amended R.C. 4928.141 to eliminate the provisions which authorized an electric security plan (ESP) filed under R.C. 4928.143 to be the SSO mandated by R.C. 4928.141 and repealed R.C. 4928.143 in its entirety.”

“On January 31, 2025, FirstEnergy filed an application to establish the Companies’ sixth ESP for a period beginning with the date that the Companies’ new base distribution rates go into effect in their most recent base rate case1 through May 31, 2028. 

“The Commission notes that FirstEnergy’s application in this proceeding was filed pursuant to R.C. 4928.143. In light of the fact that Sub. HB 15 repealed R.C. 4928.143, the Commission finds that the application should be dismissed.”
