Substantial Revisions Proposed To Solar Energy Pilot Program – Comments Sought

The New Jersey Board of Public Utilities (BBU) is proposing substantial changes upon adoption to the rules that establish the Dual-Use Solar Energy Pilot Program (Pilot Program) to bring the Board’s rules into compliance with P.L. 2021, c. 170 (the “Dual-Use Solar Energy Act”). 

There was a virtual webinar held on January 9, 2026, at 1 pm.

Adopted on January 5, 2026 at 58 N.J.R. 60 (a), with an expiration date of February 27, 2026.

The approved notice of proposed rulemaking (NOPR) was published in the January 5, 2026, issue of the New Jersey Register.  The deadline for written comments on this matter is 5:00 p.m. on Friday, March 6, 2026.

As previously reported, on December 17, 2024, the NJBPU posted Questions & Answers regarding the Dual-Use Pilot rule proposal. 

As previously reported, the Pilot Program is designed to incorporate incentives for dual-use solar facilities, also known as agrivoltaics, within the larger Successor Solar Incentive (SuSI) Program, which serves as the permanent program for providing solar incentives to qualified solar electric generation facilities. The Notice of Proposed Substantial Changes Upon Adoption (NOPSCUA) reflects lessons learned from the implementation of the Pilot Program to date and provides stakeholders with the opportunity to comment upon changes intended to improve the effectiveness of the Pilot Program.
