ALJ Order Finds FirstEnergy’s Electric Rates Should Not Go Into Effect

ALJ issued a recommended decision that (1) FirstEnergy should not place into effect the rates in Supplement No. 3 to Tariff Electric Pa. P.U.C. No. 1 “as it has been found to be unjust”; (2) the joint petition for approval of settlement of all issues should be granted; (3) Pennsylvania Electric must file the pro forma tariff supplement contained in Appendix A for service rendered on 1/1/25 designed to produce $225 million in additional annual base rate operating revenue; (4) FirstEnergy must refund $13.6 million to customers through a one- time bill credit on the basis of 2023 distribution revenues; and (5) FirstEnergy must file with the Commission’s Bureau of Technical Utility Services a list that details by rate class how much in dollars will be refunded to each rate class as a result of the regulatory liability refund.
