Bills to Watch
On September 25, 2024, Governor Hochul signed S9188 / A9827, which requires the PSC to publish information prior to a major rate change by a gas or electric utility, including an explanation of why the rate change is requested and a summary of how the proposed revenue will be spent.
The Governor also signed S6710, which establishes civil penalties for making false material statements to the PSC in relation to a rate proceeding. The penalty will be up to $250,000 for any utility and its officers, agents or employees that knowingly make a false material statement, representation or certification to the PSC in any rate proceeding.
On September 18, 2024, Assemblyman Slater introduced A10723, which requires the Office of Renewable Energy Siting to develop standards and conditions for the siting of certain large scale renewable energy systems and requires approval of municipalities to such siting plans.
On September 6 , 2024, Senator Mattera introduced S09903 which enacts the Credit for Rural Energy Infrastructure Act of 2025 which will provide tax credits for certain activities expanding energy infrastructure into unserved rural areas.
Senate Republicans unveiled a legislation package that seeks to delay the state’s statutory mandates under the CLCPA by 10 years and would require a thorough cost study. The legislation also includes more tax credits for residential solar and hydroelectric plants and would prevent the state from closing any power plants before new facilities come online and would require the state to invest in “alternative energy” options, including studying the feasibility of reopening the Indian Point nuclear power station.
