Commission Files Settlement Agreement Regarding Dayton Power & Light’s Billing Issues
The Ohio Public Utility Commission filed a Settlement Agreement regarding Dayton Power & Light’s (d/b/a AES Ohio) billing issues regarding its AES Customer Ecosystem (“ACE”) project, implemented in September 2024.
The ACE project was a new billing system with the ability to integrate with various other systems, including but not limited to the Company’s Advanced Metering Infrastructure, Geographic Information System, Enterprise Resource Planning System and Integrated Voice Response, customer portal, mobile applications, and Outage Management System. The Commission investigated customer complaints regarding the billing issues.
Pursuant to the July 21, 2026 Stipulation and Recommendation, AES Ohio committed to a Performance Incentive Metric regarding its billing efficiency during its Three Year Rate Plan and to investing amounts, not recoverable from customers, to implement programming changes to ACE and related systems to preserve the relationship between shopping customers and their competitive retail electric service providers when those customers transition to joint billing. Dayton Power & Light has worked to resolve the issues and has also provided regular updates to Staff regarding progress.
According to the Settlement Agreement:
AES Ohio will pay the current balance of any back-billed charges for PIPP customers.
AES Ohio agrees through the end of 2026, to not disconnect or charge any late payment fees or deposits to any customers who owe a back-billed balance greater than 90 days.
For consumers with unbilled and otherwise collectible charges, AES Ohio will back-bill each consumer but apply credits pursuant to the stipulation. This includes the statutory limitation that the maximum amount AES may seek to recover from a customer in any billing month is one twelfth (1/12) of the undercharge, plus regular monthly charges, unless the customer agrees to pay a larger amount. To the extent a customer would be otherwise eligible for this offer and is already on a payment plan with AES Ohio, AES Ohio must offer to amend the customer’s current payment plan to allow for payment over a two-year period.
AES Ohio will credit $50 per customer to all non-PIPP residential AES Ohio customers who were unbilled for three or more months due to the issues identified the initial Notice and the Amended Notice. The total payment amount is $900,950. The amount will be split between 18,019 customers as of July 15, 2026.
AES Ohio will make a one-time contribution of $300,000.00 to its Gift of Power program.
