PUCT Lays Out Two Options for Formal Complaint Against BKV

On March 27, 2026 the Public Utility Commission of Texas (PUCT) issued an order requiring response from complainant.

As reported previously, Billy Sorrells has filed a formal complaint against BKV-BPP Retail LLC regarding electric service.

“The purpose of this Order is to provide notice to Mr. Sorrells of a newly implemented process involving two options by which his concerns about BKV-BPP can be evaluated by the Commission and to ask him to choose one of the two options.”

Option 1: Mr. Sorrells may pursue and prosecute his own complaint. Under this option, Mr. Sorrells maintains responsibility for pursuing and proving his complaint. Option

Option 2:  Alternatively, Mr. Sorrells may request the Commission’ s Division of Compliance and Enforcement (DICE) to investigate and take appropriate action. Under this option, Mr. Sorrells turns over responsibility for investigating his complaint to DICE. Each of these options is discussed in more detail below and will also be discussed in a phone call with Mr. Sorrells from Commission Staff with DICE.

Option 1 – Formal Complaint

Currently, Mr. Sorrells’ filing constitutes a formal complaint brought under 16 Texas Administrative Code (TAC) § 22.242, which is an official request for the Commission to decide a dispute, similar to a lawsuit in court. The processing of a formal complaint is like a trial and may involve a hearing with evidence, direct testimony, and cross examination of witnesses. If Mr. Sorrells wishes for this case to remain a formal complaint, he has the burden of proving his case and demonstrating that BKV-BPP committed actions that violated a tariff, law, rule, or order that the Commission has jurisdiction to enforce.

Formal complaints can address whether a complainant is owed a refund or determine whether the utility service provider complied with the laws that the Commission has jurisdiction to enforce. However, the Commission, as a state agency, does not have authority to order some forms of relief that are available in courts of law, such as awarding attorney’ s fees, court costs, or damages under contract law.

Option II – DICE Alternatively, Mr. Sorrells may request that the formal complaint be withdrawn and that the matter be turned over to DICE to investigate and take appropriate action. If Mr. Sorrells chooses this option, the information provided by him will be independently investigated and evaluated by DICE, which will take appropriate steps, which may include, but are not limited to, requesting the Commission impose administrative penalties or require corrective action. In such a case, attorneys from DICE may bring an enforcement action against BKV-BPP. Mr. Sorrells would not be a party to any enforcement action that might result from the DICE investigation, although DICE may seek information and cooperation from Mr. Sorrells. In such event, DICE would have the burden of proving the case.

“By April 20,2026, Commission Staff from DICE must: (1) contact Mr. Sorrells to discuss the two options identified above; and (2) file a notice of appearance in this docket.”
