Texas Court Confirms Grants Temporary Injunction

Directs BKV Retail Energy to Remove ‘Switch Hold’

After a hearing was held on March 5th, a Texas Harris County District Court in Docket: 202611413 confirms its prior temporary restraining order (TRO) directing BKV-BPP Retail LLC (BKV Energy) to remove a switch hold that had previously been placed on the ESI ID of Billy Sorrells a customer.

As reported previously, the court issued the TRO on an emergency basis without holding a hearing, citing health and safety concerns related to the household’s lack of electric service.  A hearing on the matter was held on March 5, as the TRO would have expired after 14 days unless the court decided to extend it.

In the court filing, BKV Energy attached a copy of the confirmation from CenterPoint Energy Houston Electric (the transportation and distribution utility or TDU) showing that on February 24, 2026 the TDU had received confirmation that the switch-hold on the complainant Sorrells’ ESI ID had been removed.  The court noted that BKV Energy, “has confirmed compliance with releasing switch hold.”

Among other things, the Court granted the temporary injunction finding that the Defendant [BKV Energy] “will suffer no monetary damages or competitive injury from releasing the switch hold, as Defendant has already terminated service to Plaintiffs and the requested relief merely permits Plaintiffs to enroll with an alternative retail electric provider.”

The court also found that, “[t]he harm to six minor children and one elderly person from continued deprivation of electric service vastly outweighs any potential harm to Defendant from being required to release the switch hold.”

As previously reported, a switch hold had been applied to the customer Billy Sorrells, III (Complainant) due to alleged non-payment resulting in Sorrells filing a formal complaint against BKV-BPP Retail LLC at the Texas Public Utility Commission (PUC) in docket number 59122.

As previously reported in the complaint, Sorrells generally alleges that BKV-BPP Retail had disconnected the customer without proper notice or documentation, which Sorrells argues is contrary to the PUC rules.

Note that this matter remains open at the TPUC in docket 59122.
