Reply Briefs Filed In Utility EDI Data Exchange Complaint
On August 23, 2026 parties filed reply briefs regarding Inova’ EDI complaint filed against Pike and Corning.
Inova Energy filed a reply brief emphasizing that the 2019 EDI waiver changed the method of data exchange rather than eliminating Pike’s underlying supplier data, scheduling, and load-profile obligations.
Pike and Corning argue that Inova Energy failed to prove a supplier-coordination violation, maintaining that Rules 4.12(c) and 6.2.3 and monthly ECL delivery were not triggered because Inova Energy never served Pike customers. Even if applicable, Pike says it provided the required historical usage, ECL, capacity, and load-profile/strata information, including data obtained from O&R. Pike and Corning also reject Inova’s market-exclusion and discrimination claims, noting that Inova was cleared to serve customers, secured fixed-price commitments, and acknowledged Pike was not blocking it from doing business. Pike argues Direct/NRG was differently situated because it was an incumbent supplier already serving customers.
